California Privacy Notice

Your rights under the California Consumer Privacy Act, and how we answer them.

Why this page exists

Martian Creative, LLC is a small California company. The California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies by its own terms to businesses above certain thresholds — annual revenue over twenty-five million dollars, or handling the personal information of a hundred thousand or more consumers, or making half their revenue from selling personal information. We are below every one of those thresholds, so the Act does not currently oblige us.

We are publishing this anyway, and honoring the rights below anyway, because they are reasonable and because you should not have to work out whether a company is big enough to have to be decent. If we ever cross a threshold, nothing on this page will need to change.

What we collect, in the Act’s categories

Identifiers — your name, email address and station name. Collected directly from you when you create an account. Kept so we can sell you a license, send it to you, and support you.
Commercial information — which licenses you have bought and the identifiers that connect them to a Stripe payment. Kept for billing, tax and support.
Internet activity — a session cookie that keeps you signed in, and standard web server logs kept by our host. We run no analytics, no advertising pixels and no cross-site trackers.
Everything else in the Act’s list — biometric data, geolocation, audio or visual recordings of you, professional or education records, and inferences drawn to build a profile — we do not collect at all.

We collect no sensitive personal information as the Act defines it. There is therefore nothing for you to limit the use of.

We do not sell or share your personal information

We have never sold personal information, and we do not share it for cross-context behavioral advertising — the two things the Act is most concerned with. That is true of every category above, it has been true since the day this company started, and it applies to minors as it applies to everyone.

Because there is nothing to opt out of, you will not find a "Do Not Sell or Share My Personal Information" link on this site. If that ever changes, the link will appear and we will say so loudly.

Your rights, and how to use them

To know what personal information we have collected about you, where it came from, why we have it, and who we disclosed it to.
To a copy of it, in a portable form.
To correct anything inaccurate.
To delete it, subject only to what we must keep for tax and accounting.
To limit the use of sensitive personal information — which for us is moot, since we collect none.
Not to be discriminated against for exercising any of these. We will not charge you more, give you less, or make the product worse because you asked.

To exercise any of them, write to hello@cartwright.fm from the address on your account, or call (707) 505-8885. We will confirm we received it within ten days and answer within forty-five, which the Act allows us to extend once if the request is complicated — we will tell you if we need to.

You may use an authorized agent. We will ask for written permission signed by you, and we will verify you directly, because the alternative is handing your information to whoever asks.

How we verify it is you

For most requests, replying from the email address on your account is enough. For a request to delete everything, we will ask you to confirm from that address a second time — an irreversible action deserves a moment of friction.

If we cannot verify you, we will say so rather than guess, and we will not use anything you send us for verification for any other purpose.

Shine the Light, and browser signals

California’s "Shine the Light" law lets residents ask about personal information disclosed to third parties for their own direct marketing. We disclose none, to anyone, for that purpose.

We honor Global Privacy Control and Do Not Track signals by having nothing for them to turn off: there is no tracking on this site to disable.
