The agreement between your station and Martian Creative, LLC for the use of Cartwright.

Who this is between

Cartwright is made by Martian Creative, LLC ("we", "us"). These terms cover your use of the Cartwright software and of cartwright.fm ("the site"). By creating an account or installing the software, you agree to them.

What you are buying

A license to run Cartwright at one radio station. The license covers two installed copies of the desktop application. Other computers on your station's network may use Cartwright through a web browser without limit, because they are talking to the copy you already licensed.

A license is issued to your station and is not transferable to another station without asking us first. We will not unreasonably refuse — stations are bought and sold, and that is ordinary.

Everything in the product is included at one price. There are no per-seat charges and no modules sold separately.

The trial

A trial runs for thirty days and is the complete product, not a cut-down version. It takes no card, so there is nothing to cancel — if you do nothing, it simply stops working and your data stays on your machine.

Paying, and stopping

Subscriptions are billed monthly or annually in advance through Stripe. Prices are shown on the site before you buy and are charged in US dollars.

You may cancel at any time and your license runs to the end of the period you have paid for. We do not refund part-periods as a matter of course, but if something went genuinely wrong, write to us — we would rather fix it or refund it than argue.

If we change the price, we will tell you before it applies to you, and never in the middle of a period you have already paid for.

This is beta software

Cartwright is in beta. One station has run it every day since it was written, which means the parts that matter are proved on air daily — and you will find rough edges in the parts that are not. We say so on the site rather than in the small print because it should affect your decision.

We ask beta customers to tell us what broke. The app has a button for it.

Your data is yours

Your station's database — advertisers, orders, contracts, logs, recordings, everything — lives on your own machine. We do not hold a copy, we cannot read it, and it keeps working if this website disappears entirely. Cartwright includes an export, and you may take your data and leave at any time.

What we do hold is described in the Privacy Notice: your account, your licenses, and the record of what you paid.

What we ask of you

Do not share your license key outside your station, or use one license to run several stations.
Do not attempt to defeat the licensing, decompile the software, or resell it as your own.
Do not use the software to break the law — including, since this is radio, the rules the FCC applies to sponsorship identification, payola, political advertising and non-discrimination in advertising sales.

We may end a license for a serious or repeated breach of the above. If we ever do, you keep your data and we will say why.

What we do not promise

Cartwright writes a traffic log into a folder your automation watches, and reads its play history back. We do not control your automation software, your network, your computers or your electricity, and we cannot promise that a log reaches air — only that we have built this to give it the best chance and to tell you loudly when something is wrong.

The software is provided "as is". To the extent the law allows, we exclude implied warranties, and our total liability for any claim is limited to what you have paid us in the twelve months before it. Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.

Keep backups. The software makes them for you and puts them where you tell it. Check that it is doing so.

Other companies we name

Cartwright interoperates with software your station already runs, and with services we use to run our business. Where those products are named, they are named to describe what Cartwright connects to. No affiliation, sponsorship or endorsement is implied, and all trademarks belong to their owners.

Changes, and which law applies

If we change these terms we will post the new version here with a new date, and tell account holders by email when the change is substantial. Continuing to use the product after that is agreement to the new terms.

These terms are governed by the laws of the State of California, and the courts of California are where any dispute is heard.
